Poland’s Constitutional Crisis Exposes a Forgotten Socialist-Era Legacy

WARSAW, October 30, 2026 — Police entered the grounds of Poland’s Constitutional Tribunal on Friday as reports of its leaders’ suspension brought the long-running battle over the court to a head. President Karol Nawrocki cut short a journey to Senegal and returned to Warsaw.
The tribunal’s social-media representatives disputed the reported suspensions and accused those responsible of an unlawful takeover and a coup d’état. Warsaw police said they were responding to security concerns, including aggressive behavior near the court.
The institution at the center of this post-1989 power struggle was created by socialist Poland. The Polish People’s Republic established the tribunal constitutionally in 1982, adopted its founding statute in 1985 and saw it issue its first judgment in 1986.
Constitutional review grew out of legal debates within the socialist republic. The post-1989 state inherited that institution and expanded its authority.
Under the original system, parliament could overturn the tribunal’s rulings. Its powers changed substantially during the political transition, but its foundation predates the capitalist restoration.
The present deadlock has identifiable actors. Reuters reports that Nawrocki refused to swear in three of six judges nominated by parliament, while tribunal president Bogdan Święczkowski blocked judges chosen by the current parliamentary majority from taking up their duties.
Those decisions have left the tribunal effectively paralyzed. Rival political camps are fighting over who can lead the court and which judges can sit on it.
More than three decades after the end of the Polish People’s Republic, its successors are struggling for control of a constitutional institution built under socialism.
